# Migration Policy Restrictiveness

## What this driver is

Migration policy restrictiveness is a continuing meter of how tightly states and the Union screen, detain, return, and share (or refuse to share) responsibility for people seeking entry or protection. It is not the NEW Mediterranean event bundle. That bundle holds the 2016 EU-Turkey Statement, Malta 2017, Pylos, and the Pact as route-and-deterrence events. This node is how restrictive the rules are.

The driver is not [Anti-Immigration Sentiment](/drivers/anti-immigration-sentiment) (demand) and not [Migration Pressure](/drivers/migration-pressure) (volume). Those neighbouring nodes can move with this meter. They do not replace it. It is not Ukraine war.

It applies to receiving and transit systems over time. The 14 May 2024 Council adoption of the Pact on Migration and Asylum — including Regulation (EU) 2024/1351 — is a first-order Union instrument in this neighbourhood, with application from 12 June 2026. That date is an Official Journal clock, not a unique Factrail headcount.

The documentary core is the Pact package, national border-procedure laws, and the 2016 statement as a neighbouring deal. A speech that calls a procedure “orderly” does not change those instruments.

## Mechanism

Restrictiveness moves welfare through named channels.

First, screening and border procedures. The Pact’s screening regulation and mandatory border procedure for specified caseloads convert arrival into a fast-track with limited movement. Two years were given to apply after 14 May 2024.

Second, returns and third-country deals. EU-Turkey 2016, Italy–Libya 2017, and later Italy–Albania protocols externalise processing. Independent monitors document pullbacks. This page does not invent a unique return integer.

Third, responsibility-sharing. Regulation (EU) 2024/1351 replaces Dublin with a solidarity/responsibility formula. A formula is not a completed relocation.

Fourth, the meter’s limits. This node does not currently carry a dedicated global restrictiveness index on Factrail. A later IMPIC-style series would be a better meter.

Timing is months for a national decree and years for the 2026 Pact clock. A later genuine individualised procedure would be a new fact. It would not twin the Mediterranean bundle.

## Evidence base

The Council press release of 14 May 2024 records adoption of ten acts (https://www.consilium.europa.eu/en/press/press-releases/2024/05/14/the-council-adopts-the-eu-s-pact-on-migration-and-asylum/). Regulation (EU) 2024/1351 is the management regulation (https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32024R1351). The EU-Turkey Statement of 18 March 2016 remains the neighbouring eastern-route deal.

This page does not invent a unique detention, return, or drowning integer as Contribution.size. Where IOM or UNHCR prints a running figure, that figure stays on those agencies and on the Mediterranean bundle.

Evidence is strongest for adopted regulations and Council statements. It is weaker for any unique first-week compliance coefficient. It is weakest where an “invasion” adjective is asked to replace the Official Journal.

## Effect on welfare indicators

This driver, when it actually runs, is a first-order channel into protection-voice.

- [Having a say in government](/indicators/government-welfare-083-having-a-say-in-government): direction lower protection-voice when border procedures and third-country deals close individualised asylum; direction polarised civic voice in receiving states. Horizon: months to the 2026 clock. Confidence: medium-high for the dated Pact; low for a unique global coefficient. The indicator is higher-is-better. Strengthening restrictiveness is welfare-negative on protection-voice. No unique detention integer is invented here.

Missing coefficients stay missing. Do not hang this file on [territorial-revisionism](/drivers/territorial-revisionism).

The welfare sign of strengthening this meter is negative for people whose claims are channelled into closed procedures. That is the opposite of treating a Pact application date as a humanitarian miracle.

## Interactions and contested points

The mechanism interacts with mediterranean-migration, anti-immigration-sentiment, and migration-pressure when a wreck, a campaign, and a regulation sit in the same year. Reinforcement is obvious. Offsetting is the Council language that the Pact “saves lives by breaking the smugglers’ business model.” That claim can be stored. It does not cancel IOM’s Missing Migrants series on the neighbouring bundle.

The strongest competing view is that restrictiveness is lawful sovereignty and that the Pact is solidarity. The text is solidarity-plus-border-procedure. Both clauses are stored.

A second competing view is that this node should be merged into mediterranean-migration. It should not. The Mediterranean file is a route event bundle. Restrictiveness is the global/Union rules meter.

A later dedicated restrictiveness series would update the meter.
