# EU platform regulation (DSA/DMA)

## What this driver is

EU platform regulation (DSA/DMA) is one continuing Union mechanism: two directly applicable regulations that treat very large online platforms and designated digital gatekeepers as objects of due-diligence and contestability duties, not as ordinary websites. It is a mechanism with Official Journal dates, designation decisions, and application clocks. It is not a mood called “Big Tech” and not a unique user-count integer invented here.

It is not [Digital Platform Power Concentration](/drivers/digital-platform-power-concentration) as a second name for the same EU file. Those neighbouring nodes can move with this mechanism. They do not replace the two regulations or the 2023 designation waves. It is not Ukraine war.

It applies from the 14 September 2022 Digital Markets Act and the 19 October 2022 Digital Services Act through the 25 April 2023 first VLOP/VLOSE list, the 5–6 September 2023 first DMA gatekeeper list, the August 2023 VLOP additional-obligation clock, 17 February 2024 general DSA application, and the March 2024 DMA obligation clock. It is not Glavlit and not [territorial-revisionism](/drivers/territorial-revisionism).

The legal core is Regulation (EU) 2022/1925 of 14 September 2022 on contestable and fair markets in the digital sector (DMA), published OJ L 265, 12 October 2022; Regulation (EU) 2022/2065 of 19 October 2022 on a Single Market for Digital Services (DSA), published OJ L 277, 27 October 2022, Article 93 of which applies the bulk of the DSA from 17 February 2024; the Commission’s 25 April 2023 designation of 17 VLOPs and 2 VLOSEs; and the Commission’s 5 September 2023 DMA designation decisions, announced 6 September 2023, naming Alphabet, Amazon, Apple, ByteDance, Meta, and Microsoft for 22 core platform services. A press line that calls the package “historic” does not change those instruments.

## Mechanism

The file moves welfare through named channels.

First, a gatekeeper statute with quantitative presumptions. DMA Article 3 designates an undertaking that has a significant impact on the internal market, provides a core platform service that is an important gateway, and enjoys an entrenched position. Article 3(2) presumes those tests at the regulation’s own thresholds (including 45 million monthly active end users). This page does not convert those thresholds into Contribution.size. On 3 July 2023 Alphabet, Amazon, Apple, ByteDance, Meta, Microsoft, and Samsung notified. On 5 September 2023 the Commission designated six gatekeepers and did not designate Samsung’s browser. Six months later, in March 2024, the designated core platform services had to comply.

Second, a due-diligence statute for intermediaries, with a higher layer for very large services. DSA Article 93 applies the regulation from 17 February 2024, with earlier application of designation machinery from 16 November 2022. Services at or above the regulation’s 45 million average monthly active recipients are designated as VLOPs or VLOSEs and, four months after notification, must assess and mitigate systemic risks. On 25 April 2023 the Commission designated 17 VLOPs and 2 VLOSEs. Additional VLOP duties for that first set ran from the end of August 2023. On 20 December 2023 three further VLOPs were designated.

Third, Commission supervision rather than a unique fine integer. [Margrethe Vestager](/people/tech-margrethe-vestager), as Executive Vice-President for a Europe fit for the digital age, and [Thierry Breton](/people/thierry-breton), as then Commissioner for the internal market, were the public faces of designation and early enforcement. [Ursula von der Leyen](/people/energy-ursula-von-der-leyen), as Commission President, is head of the college that adopted the designation decisions. [Roberta Metsola](/people/gov-roberta-metsola), as President of the European Parliament, signed the DSA with the Council presidency. Sharing a press conference does not move the Official Journal off the co-legislators. Later non-compliance probes (including the 25 March 2024 DMA probes into Apple, Alphabet, and [Meta](/people/ilir-meta) already stored on the live digital-rights companion) are enforcement of this mechanism. Contested penalty amounts stay on the named Commission decisions. This page does not invent a unique euro coefficient.

Fourth, speech and contestability collide. DSA crisis-response and systemic-risk duties can require platforms to act on illegal content and on risks to civic discourse. DMA interoperability, anti-steering, and sideloading duties can reduce gatekeeper lock-in. Platforms and some member-state politicians call the DSA a censorship machine. Gatekeepers call the DMA a tax on product design. Those claims are stored. They do not cancel Article 93 or Article 3.

Timing is months for a designation clock and years for court review. A later annulment, a later de-designation, or a later AI Act enforcement wave would be a new dated fact.

## Evidence base

The best evidence is Official Journal text and Commission designation press and decisions.

Regulation (EU) 2022/1925 of 14 September 2022 is the DMA (https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32022R1925). Regulation (EU) 2022/2065 of 19 October 2022 is the DSA, including Article 93’s 17 February 2024 application date (https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32022R2065). The Commission press release of 25 April 2023 records the first 17 VLOPs and 2 VLOSEs (https://ec.europa.eu/commission/presscorner/detail/en/ip_23_2413). The Commission press release of 6 September 2023 records the first six DMA gatekeepers and 22 core platform services (https://ec.europa.eu/commission/presscorner/detail/en/ip_23_4328). Commission Decision C(2023) 6101 of 5 September 2023 designates Alphabet; parallel 5 September decisions designate the other five. The Council records DSA adoption on 4 October 2022 and application from 17 February 2024.

This page does not invent a unique EU user census, a unique fine total, or Contribution.size. The 45 million monthly-active threshold is the regulation’s own figure. Where a later Commission decision prints a penalty, that figure stays on that decision.

Evidence is strongest for a published regulation, a designation press release that names the services, and a Commission decision PDF. It is weaker for any unique first-week compliance coefficient. It is weakest where a “Brussels vs innovation” talking point is asked to rebate Article 93.

## Effect on welfare indicators

This driver, when it actually runs, is a first-order channel into civic voice and the terms on which users and business users meet designated platforms.

- [Having a say in government](/indicators/government-welfare-083-having-a-say-in-government): direction mixed-to-higher civic capacity when DSA transparency, researcher access, and systemic-risk duties, and DMA anti-steering and contestability duties, are actually applied; direction lower civic capacity if crisis procedures or illegal-content duties are used to suppress lawful opposition speech. Horizon: four to six months after designation for the first duty clocks, years for court review. Confidence: high for the dated instruments; medium for any unique global coefficient from those instruments to a worldwide say-in-government reading. The indicator is higher-is-better. This page does not invent a unique speech-takedown integer.

An electricity-access or PISA path does not follow from a designation list without a sourced channel. Missing coefficients stay missing. Do not hang this file on territorial-revisionism.

The welfare sign of a completed DSA/DMA instrument is not automatically negative. Protective and contestability duties can raise a higher-is-better civic-voice reading; a speech-restrictive application can lower it. The dated instruments dominate.

## Interactions and contested points

Reinforcement is obvious when a VLOP list and a gatekeeper list land in the same year. Offsetting is the claim that DSA “illegal content” duties and DMA interoperability mandates reduce product quality or chill lawful speech. Those claims can be stored. They do not cancel the 25 April 2023 or 5 September 2023 decisions.

The strongest competing view is that DSA is a censorship statute aimed at U.S. platforms, that the 45 million threshold is arbitrary, and that DMA gatekeeper duties punish success. The competing defence is the co-legislated text: designation follows published user numbers and Article 3 presumptions; VLOP additional duties are risk assessment and mitigation, not a prior-restraint board; DMA rebuttals were heard (Samsung’s browser was not designated).

It is not. Those are LIVE global metrics. This node is the Union DSA/DMA event bundle: two regulations, two designation waves, and the 2024 application clocks.

Established: DMA 14 September 2022; DSA 19 October 2022 with 17 February 2024 general application; 25 April 2023 first VLOP/VLOSE list; 5–6 September 2023 first six gatekeepers for 22 core platform services; March 2024 DMA compliance clock. Not established: a unique user census or fine total as Contribution.size; minted pages for [Henna Virkkunen](/people/henna-virkkunen) or for Apple/Google/Meta executives. A later General Court judgment on a designation would be a new fact.
