# TCP 0084/2017 sets aside term limits citing the American Convention

Date: 2017

## The fact

On 28 November 2017 Bolivia’s Plurinational [Constitutional Tribunal](/organizations/constitutional-tribunal) sitting en banc issued judgment 0084/2017 setting aside constitutional term limits for president, vice-president, governor, mayor and councillor, citing the American Convention on Human Rights. OAS later recorded that judgment as the legal parent of the 2019 Morales ticket.

## Context

MAS legislators had brought the challenge. He was the sitting president. He did not sit as a TCP magistrate.

21 February 2016 referendum is parent. 20 October 2019 election is a child. Keep TCP 0084/2017 sets aside term limits citing the American Convention on 2017-11-28 separate from neighbouring 21 February 2016 referendum, 28 November 2017 TCP 0084/2017, 10 November 2019 resignation, 14 November 2024 TCP MAS resolution, and 31 March 2025 EVO Pueblo.

The president of Bolivia was head of state, head of government, and commander-in-chief until November 2019. A living former president can convene a party congress and call blockades. He does not sit as a TCP magistrate, a TSE precinct printer, or an OAS auditor.

## Evidence and sources

Tribunal Constitucional Plurinacional of Bolivia carries the official instrument or communique. Organization of American States records the same dated act independently.

## Significance

The path is capacity for peaceful transfer: a completed court override of a referendum NO.

## What is established and what is not

Established: TCP 0084/2017 set aside term limits on 28 November 2017; OAS recorded it as the parent of the 2019 ticket.

Not established: A unique later human-rights coefficient, or that the 2016 NO never happened.

What would change the picture: a contradictory original with a different date or name, a later repeal, a court that vacated the instrument, or a measured series that can be argued, with lag and alternatives, as a consequence of this instrument rather than of later institutions.

The date is the date of this instrument, not a licence to back-date every later harm or benefit.

MAS legislators asked. He was the beneficiary candidate.. A later repeal, court stay, or successor order would be a different Fact with a different date. That pair identifies TCP 0084/2017 sets aside term limits citing the American Convention, not a later speech about TCP 0084/2017 sets aside term limits citing the American Convention.

Co-authors and later implementers named in Context remain on the file. TCP 0084/2017 sets aside term limits citing the American Convention on 2017-11-28 is not a licence to treat every later Tribunal Constitucional Plurinacional of Bolivia communique as this same act. If a later repeal, stay, or successor instrument exists, it needs its own date and its own row. This dossier refuses to average TCP 0084/2017 sets aside term limits citing the American Convention into a personality. The contribution described on this Person row is limited to TCP magistrates wrote. MAS legislators asked. He was the beneficiary candidate. That limit is the alternative to treating office-holding as authorship of every later series.
