# Chutkan dismisses Trump federal election case at prosecutors' request

On 25 November 2024 Judge [Tanya Chutkan](/people/tanya-chutkan), who had presided over the case, granted Special Counsel [Jack Smith](/people/jack-smith)'s motion, filed the same day, to dismiss the federal election-subversion case against President-elect [Donald Trump](/people/mig-donald-trump) without prejudice. The request followed Justice Department policy against prosecuting a sitting president.
