# Electoral commission declares Félix Tshisekedi the winner

Date: 2019

[Félix Antoine Tshisekedi Tshilombo](/people/felix-tshisekedi) is a Congolese politician who is the fifth president of the Democratic Republic of the Congo, serving since 2019.

### Provisional election victory amid a disputed tally and lethal protests

On 10 January 2019 the Democratic Republic of Congo's electoral commission, CENI, provisionally declared Félix Tshisekedi the winner of the presidential election held on 30 December 2018. The announcement surprised observers because independent reporting and Catholic Church monitoring suggested that another opposition candidate, [Martin Fayulu](/people/martin-fayulu), had attracted substantially more votes. CENI's published share for Tshisekedi was around 38.6 percent, compared with roughly 34.8 percent for Fayulu. The official figures were contested immediately, so reporting them as the commission's announcement is different from presenting them as an independently verified count of the electorate's preferences.

The ballot took place after repeated postponements under outgoing president [Joseph Kabila](/people/joseph-kabila), who had remained in office beyond the scheduled end of his mandate. Human Rights Watch documented problems with electronic voting equipment, restrictions on independent monitoring and delayed polling in several opposition-supporting areas. More than one million people were unable to vote in three areas whose polls were deferred to March 2019. Authorities also shut down internet and text-messaging services after the 30 December election, limiting scrutiny while results were being tabulated. These factors bear directly on [electoral integrity and competitiveness](/drivers/electoral-integrity-and-competitiveness).

Fayulu rejected the declared result and pursued legal challenges. On and after 10 January 2019 protests erupted in several cities, and security forces used excessive force; Human Rights Watch subsequently documented at least ten people killed during post-election demonstrations. The Constitutional Court later confirmed Tshisekedi, who assumed the presidency that month, producing the first handover of power between presidents in the country's history. The transfer was institutionally significant but did not resolve the disputed count. In February 2019 rights monitors called for accountability for protest killings. The event therefore combines a formal change of office with unresolved legitimacy concerns and real human harm; neither dimension is erased by the other.
