# Commission guidance expands review of below-threshold ‘killer’ acquisitions

In 2020–2021 the Commission published guidance encouraging Article 22 referrals of below-threshold deals, the theory later used in Illumina/GRAIL. A later court limited the theory. The guidance is a completed policy act with judicial fragility.
