## The fact

On 3 August 2023 the State Department for Housing, after the Court of Appeal lifted a freeze on the Finance Act, appointed the Kenya Revenue Authority to collect the 1.5 percent employee and 1.5 percent employer affordable-housing levy, backdated to 1 July.

## Context

Charles Hinga’s state department issued the public notice. KRA published the itax sheet. Employers deducted. Courts were still seized. He owned the Act being implemented. He did not personally run payroll software.

The High Court judgment later that year and the Affordable Housing Act 2024 are neighbouring later instruments.
