# Kenya’s Supreme Court unanimously upholds Ruto’s presidential election

Date: 2022

## The fact

On 5 September 2022 Chief Justice Martha Koome, for a unanimous seven-judge Supreme Court, dismissed the consolidated presidential petitions and declared [Ruto](/people/william-ruto) validly elected.

## Context

Odinga’s petitions alleged server interference and form substitution. The court found no evidence that met the constitutional threshold to annul. Ruto was the first respondent. He did not write the judgment.

The IEBC declaration is 15 August. The inauguration is 13 September. Keep the three dates separate.

The president of Kenya is head of state and government under Article 131, commander-in-chief, and assents to bills Parliament has passed. He does not write IEBC gazette notices, Supreme Court judgments, UN Security Council resolutions, or IMF board decisions.

## Evidence and sources

Judiciary of Kenya carries the official instrument or communique. Reuters records the same dated act independently.

## Significance

The path is [democratic resilience](/drivers/democratic-resilience): a completed, unanimous presidential-petition judgment after a close vote is the 2010 Constitution’s dispute path holding. It is not a finding that every IEBC commissioner agreed.

## What is established and what is not

Established: a 5 September 2022 unanimous Supreme Court judgment upholding Ruto’s election, independently reported the same day.

Not established: that the court thereby authorised every later tax statute, or a unique later turnout coefficient.

What would change the picture: a contradictory original with a different date or name, a later repeal, a court that vacated the instrument, or a measured series that can be argued, with lag and alternatives, as a consequence of this instrument rather than of later institutions.

The date is the date of this instrument, not a licence to back-date every later harm or benefit.

The seven judges wrote the judgment. IEBC was also a respondent.. A later repeal, court stay, or successor order would be a different Fact with a different date. That pair identifies Kenya’s Supreme Court unanimously upholds Ruto’s presidential election, not a later speech about Kenya’s Supreme Court unanimously upholds Ruto’s presidential election.

Co-authors and later implementers named in Context remain on the file. Kenya’s Supreme Court unanimously upholds Ruto’s presidential election on 2022-09-05 is not a licence to treat every later Judiciary of Kenya communique as this same act. If a later repeal, stay, or successor decree exists, it needs its own date and its own row. This dossier refuses to average Kenya’s Supreme Court unanimously upholds Ruto’s presidential election into a personality. The contribution described on this Person row is limited to He was the first respondent whose election was upheld. The seven judges wrote the judgment. IEBC was also a respondent. That limit is the alternative to treating office-holding as authorship of every later series.
