# Court under Yun strikes down capital relocation law

Date: 2004

On 21 October 2004 the Constitutional Court presided over by [Yun Young-chul](/people/yun-young-chul) ruled 8–1 that the special act to build a new administrative capital was unconstitutional, holding that moving the capital from Seoul required a constitutional amendment and referendum. It treated Seoul's status as capital as an unwritten customary constitutional rule, halting the relocation plan.
