# UK Supreme Court rules the Rwanda asylum scheme unlawful

Date: 2023

On 15 November 2023, the [UK Supreme Court](/organizations/mig-uk-supreme-court) unanimously ruled that the government's plan to remove asylum seekers to Rwanda for processing was unlawful. The court found substantial grounds to believe that people sent to Rwanda would face a real risk of refoulement, being returned to countries where they could face ill-treatment, citing UNHCR evidence of systemic defects in Rwanda's asylum system. The judgment did not stop the government, then led by Prime Minister Rishi Sunak, from signing a treaty with Rwanda and pursuing the Safety of Rwanda Act.
