# The 1938 Italian racial laws strip Jews of school, office, property paths, and mixed marriage

## The fact

On 17 November 1938 the royal decree-law n. 1728 and related 1938 measures banned Jews from state schools, many professions, and mixed marriage, after the Manifesto della razza. [Mussolini](/people/benito-mussolini)’s government wrote and owned the racial turn. This is not a German import that he merely rubber-stamped; it is Italian statute.

## Context

Earlier fascist Italy had Jews in the PNF. 1938 ended that. Later RSI deportations (1943–45) are a further instrument. USHMM treats the laws as a documented stripping of rights.

Benito Mussolini’s documented role is bounded by other offices and collaborators named in the sources below. Sharing a field with them is not a reason to drop a documented act, and it is not a reason to assign later consequences done in the name after death.
