# Vance and Brown introduce the Railway Safety Act of 2023 after East Palestine

Date: 2023

## The fact

On 1 March 2023 Senators [JD Vance](/people/jd-vance) and Sherrod Brown, with Rubio, Hawley, Casey, and Fetterman, introduced the Railway Safety Act of 2023 after the 3 February Norfolk Southern derailment in East Palestine, Ohio. The bill sought two-person crews, wayside detectors, hazardous-materials rules, and higher fines. The bill did not become law.

## Context

Thirty-eight cars derailed on 3 February 2023; vinyl chloride burned. EPA and NTSB ran the federal response. Vance visited, criticised the administration, and then co-led a bipartisan bill. Committee markup later occurred; sixty votes on the floor did not. Store introduction, not enactment. Norfolk Southern remains the carrier. [Buttigieg](/people/pete-buttigieg) ran USDOT, not this bill.

The derailment itself is a Norfolk Southern/NTSB row if stored.

A United States senator can introduce, cosponsor, and vote. He cannot enact a statute without a chamber majority, a House, and a president. Introduction is not royal-style assent. A stalled bill is stored as introduction, not as law.

## Evidence and sources

Congress.gov carries the official instrument or communique. Associated Press records the same dated act independently.

## Significance

The path is health and environmental risk around hazardous rail: a completed bipartisan introduction raised expected crew and detector standards. Non-enactment caps the welfare claim.

## What is established and what is not

Established: introduction on 1 March 2023 of S.576 by Vance, Brown, and listed cosponsors. The bill did not become law in that Congress.

Not established: that two-person crews became a nationwide mandate, or a unique later derailment coefficient from introduction hour.

What would change the picture: a contradictory original with a different date or name, a later repeal, a court that vacated the instrument, or a measured series that can be argued, with lag and alternatives, as a consequence of this instrument rather than of later institutions.

The date is the date of this instrument, not a licence to back-date every later harm or benefit.

Brown co-led. Cosponsors signed. The Senate did not enact. USDOT still regulates.. A later repeal, court stay, or successor order would be a different Fact with a different date. That pair identifies Vance and Brown introduce the Railway Safety Act of 2023 after East Palestine, not a later speech about Vance and Brown introduce the Railway Safety Act of 2023 after East Palestine.

Co-authors and later implementers named in Context remain on the file. Vance and Brown introduce the Railway Safety Act of 2023 after East Palestine on 2023-03-01 is not a licence to treat every later Congress.gov communique as this same act. If a later repeal, stay, or successor instrument exists, it needs its own date and its own row. This dossier refuses to average Vance and Brown introduce the Railway Safety Act of 2023 after East Palestine into a personality. The contribution described on this Person row is limited to He co-introduced the bill. Brown co-led. Cosponsors signed. The Senate did not enact. USDOT still regulates. That limit is the alternative to treating office-holding as authorship of every later series.
