# K. S. Puttaswamy

### Context

K. S. Puttaswamy was a retired Karnataka High Court judge whose later-life challenge to India’s Aadhaar identity program gave his name to one of the country’s most important constitutional privacy cases. The petition began as a challenge to the collection and use of biometric identity data, but the litigation opened a larger question: whether privacy itself is a fundamental right protected by the Constitution. The [Supreme Court judgment](https://indiankanoon.org/doc/91938676/) delivered on 24 August 2017 answered that question unanimously through a nine-judge bench, recognizing privacy as constitutionally protected within the framework of fundamental rights.

### Record

Puttaswamy’s personal contribution was procedural but enormously consequential: by bringing the challenge, he created the vehicle through which the Supreme Court reconsidered older precedents and articulated a modern privacy doctrine. The 2017 judgment did not simply decide the technical details of Aadhaar; it established a constitutional foundation for later disputes about bodily autonomy, informational privacy, surveillance and data use. [The Indian Express](https://indianexpress.com/article/cities/bangalore/puttaswamy-passes-away-privacy-case-judge-9642667/) described his role after his death in 2024 and emphasized the landmark status of the case. The judicial reasoning, however, belongs to the nine judges, not to Puttaswamy personally.

### Consequences

The privacy ruling changed the baseline for Indian constitutional law by requiring state intrusions into privacy to be justified within a fundamental-rights framework. That does not mean every privacy claim automatically defeats government regulation, nor did the judgment itself invalidate all aspects of Aadhaar. Its deeper consequence is doctrinal: future courts, legislators and regulators must confront privacy as a protected constitutional interest rather than a merely implied policy preference. The case illustrates how an individual litigant can trigger structural legal change without holding political office.
