Converting temporary work into permanent contracts

Spain's December 2021 labour reform targeted a distinctive structural problem: employers had long relied on serial fixed-term contracts, leaving many workers unable to plan family spending, secure stable housing or build predictable careers. The reform sharply restricted the grounds for temporary hiring and encouraged indefinite contracts. Its success cannot be measured solely by the share of contracts labelled permanent, because seasonal employment, hours worked and the prospects of young employees also matter. Still, subsequent labour statistics showed a significant break from earlier contracting patterns.

Spain entered 2021 with a labour market shaped by the 2008 financial crisis, the COVID-19 shock and years of unusually high unemployment and temporary employment. The Socialist-led government negotiated a reform with employers' associations and labour unions, rather than relying on a unilateral parliamentary decree alone. On 28 December 2021 the Council of Ministers adopted Royal Decree-Law 32/2021, published in the official state gazette. The instrument made the indefinite contract the normal form of employment and limited fixed-term contracts to narrowly justified circumstances, including specific production or substitution needs.

New rules for hiring took effect in stages during 2022. Employers were given a transition period before the main contracting changes applied in late March. The reform strengthened the permanent discontinuous contract, known as fijo discontinuo, for recurring seasonal work. It also adjusted training contracts, labour inspection penalties and collective bargaining rules. Supporters argued that recurring employees would have a continuing relationship with the employer rather than being repeatedly dismissed and rehired. Critics responded that counting a seasonal permanent contract as indefinite could exaggerate continuous employment, especially when workers had long inactive periods.

The European Commission's 2023 assessment recorded that temporary employment in Spain's private sector declined from 23.6 percent in 2021 to 18.5 percent in 2022. That was a significant change, but the same report noted that public-sector temporary employment remained high, at 31.4 percent in 2022. The Commission's May 2026 study of Spain's Recovery and Resilience Plan reported that fixed-term hiring and temporary employment had declined markedly from 2022 onward and identified a structural change in contract patterns. The authors also linked reform to broader investments in worker skills and employment services, which means that changes cannot be attributed to the labour-law text alone.

More stable hiring can support household purchasing power indirectly through more reliable earnings and improved credit access; the legislation did not itself set a wage increase for every worker. The change also affects labour-market tightness, because recruiters now face different constraints when filling short-term vacancies. Businesses with fluctuating demand warned of higher administration and staffing costs, while unions emphasised reduced insecurity and bargaining power. The long-run issue is productivity growth potential: stable contracts can reward training but may not deliver productivity without investment or management improvements. The distributional stakes are particularly high for income inequality, since temporary contracts had disproportionately affected younger and less protected workers. By 2026 the question had become not whether contract classifications changed, but how employment stability, working hours and earnings evolved for the same workers over time.
