Context

Sally Yates is best understood through the office and institutional setting in which the record was made, rather than through reputation alone. Yates served as deputy attorney general under President Barack Obama and briefly as acting attorney general at the start of the Trump administration. U.S. Department of Justice (opens in a new tab) provides the documentary anchor for that role. In January 2017 she instructed the Justice Department not to defend President Donald Trump’s first travel-ban executive order because she was not convinced it was lawful or consistent with the department’s responsibility to seek justice. This matters because formal authority determines what could reasonably be attributed to Sally Yates and what remained in the hands of other officials, courts, parties, agencies or armed actors. The episode is a useful test of the difference between a government lawyer’s duty to a president and duty to law and institutional judgment. A useful reading therefore starts with chronology, separates personal choices from structural constraints, and treats later political claims as claims unless they are supported by the cited record.
