On 22 August 2024 the Secretary of State made the Social Fund Winter Fuel Payment Regulations 2024 (SI 2024/869), coming into force on 16 September 2024. From winter 2024/25 the payment in England and Wales was confined to Pension Credit and specified means-tested benefits.
Context
Rachel Reeves announced the policy on 29 July as part of a public-spending audit. Liz Kendall’s DWP made the SI under the Social Security Contributions and Benefits Act 1992. Starmer defended the choice at PMQs and in Cabinet. Recipients fell from around eleven million to about 1.3 million that winter. He did not draft the instrument line by line. He owned the Cabinet decision.
The 29 July announcement, the 10 September Commons vote defeating a reversal, and the June 2025 U-turn are different dates.
The Prime Minister of the United Kingdom is First Lord of the Treasury and chairs Cabinet. He does not enact statutes alone. Parliament enacts; courts review; the Home Office, DWP, HMT, MoJ, DESNZ and NESO implement. After 20 July 2026 he is a backbench MP for Holborn and St Pancras, not the author of Andy Burnham’s instruments. Office-holding is not authorship of every later welfare series. Allegation is not a completed judgment.
Why it matters
The path is household purchasing power and energy-price exposure: removing a near-universal pensioner heating payment reduces expected cash for fuel in the coldest months for those just above means-tested thresholds.

What the sources establish
legislation.gov.uk carries the official instrument or communique. BBC records the same dated act independently.
Established: SI 2024/869 was made on 22 August 2024 and confined Winter Fuel Payment to specified means-tested benefits from winter 2024/25.
Not established: a unique excess-winter-death coefficient from the making hour, or that every pensioner without Pension Credit was fuel-poor solely because of this SI.
DWP made the SI. Starmer defended and owned it as Prime Minister. HMRC and local authorities did not write the eligibility test.. A later repeal, court stay, or successor order would be a different Fact with a different date. That pair identifies The Social Fund Winter Fuel Payment Regulations 2024 restrict eligibility, not a later speech about The Social Fund Winter Fuel Payment Regulations 2024 restrict eligibility.
Co-authors and later implementers named in Context remain on the file. If a later repeal, stay, or successor instrument exists, it needs its own date and its own row. The contribution described on this Person row is limited to Cabinet chose the policy. DWP made the SI. That limit is the alternative to treating office-holding as authorship of every later series.
