On 23 March 2024 Hong Kong’s Safeguarding National Security Ordinance, the local Article 23 legislation, came into force after the Legislative Council passed it on 19 March.

Context

Beijing had required the SAR to enact Article 23 of the Basic Law. The 2020 national law already existed. John Lee’s government wrote the bill. Xi did not sit in the Legislative Council. He is the political principal of the central requirement.

The 2020 National Security Law is a neighbouring earlier national statute.

The General Secretary of the Chinese Communist Party, concurrently President of the People’s Republic of China and Chairman of the Central Military Commission, can set the Politburo agenda, nominate the State Council leadership, and command the armed forces. He does not write UN General Assembly resolutions, OHCHR assessments, WHO emergency-use listings, or Hong Kong ordinances by himself.

Why it matters

The path is judicial-independence erosion: a second, local security statute expands offences on top of the 2020 national law.

What the sources establish

Hong Kong Department of Justice carries the official instrument or communique. Reuters records the same dated act independently.

Established: a 23 March 2024 commencement of Hong Kong’s Article 23 ordinance after a 19 March Legislative Council passage.

Not established: that Xi personally drafted the bill, or a unique later press-freedom coefficient from commencement day.

The SAR legislature passed it. Local police implement. He is the political principal of the central requirement, not the bill’s drafter.. A later repeal, court stay, or successor order would be a different Fact with a different date. That pair identifies Hong Kong’s Safeguarding National Security Ordinance takes effect, not a later speech about Hong Kong’s Safeguarding National Security Ordinance takes effect.

Co-authors and later implementers named in Context remain on the file. If a later repeal, stay, or successor decree exists, it needs its own date and its own row. The contribution described on this Person row is limited to Beijing required the ordinance. The SAR legislature passed it. Local police implement. That limit is the alternative to treating office-holding as authorship of every later series. The National People’s Congress, the State Council, provincial governments, the People’s Liberation Army, Hong Kong’s executive, and foreign counterparties share specific files. Allegation is not a completed judgment. An OHCHR assessment is not a criminal conviction. A white paper is not a census. A UN pledge is not a delivered emissions path.
